Steps To Evict A Texas Resident:

  • Possible grounds for Eviction:
    • Non payment of rent or other sums
    • Conduct that violates term of the lease
    • Holdover (lease has expired and resident has failed to vacate after receiving non renewal)
  • Issue a written Notice to Vacate
  • File the eviction in the appropriate justice of the peace court
  • Wait for constable to either personally serve the tenant or obtain judge’s permission for alternative service
  • Attend trial before the justice of the peace
  • Purchase the writ of possession if allowed
